Georgia Scrap Metal Laws

Payment Restrictions:

Georgia has special payment restrictions, see the legal mandates below. Nexus handles ALL payment restrictions automatically. Fingerprinting:

Georgia does not require fingerprints.

Video Recording:

Georgia requires facilities to record video using security cameras. Nexus tracks time, dates and weights for each material -- making locating a video for law enforcement extremely easy!

Tag and Hold:

Georgia requires yards to tag-and-hold certain materials for a period of time to give law enforcement time to locate possibly stolen material matching that description. Once tag-and-hold expires, the material can be recycled. Nexus handles all of this scheduling for you -- 100% automated with no manual input required.

License Scanning:

Georgia requires each customers drivers license, ID card, consulate ID or passport to be scanned and kept on file. Nexus automates this process by taking a picture of the license, scanning all the data, letting you know when it expires and keeping it on file forever!

Vehicle Descriptions:

Georgia requires every purchase of scrap metal to also have the customer or drivers vehicle information recorded as part of the transaction. Nexus keeps track of every vehicle for you, as well as the number of occupants!

Taking Photographs of Materials:

Georgia requires that each material/purchase have a snapshot image to be taken while the material is being weighed. Nexus does this automatically, unlike other systems, your employees won't have to click any buttons or do anything manually to capture images.

Taking Photographs of Customers Faces:

Georgia requires a photograph to be taken of the customers face at the time of payout. Nexus does this automatically, unlike other systems, your employees won't have to click any buttons or do anything manually to capture images.

Notify Law Enforcement:

Georgia requires law enforcement notifications when certain materials are purchased. Nexus alerts you when you need to report a material and generates a tag for Tag-And-Hold.

NMVTIS Reporting:

ALL STATES, not just Georgia are required to report vehicle purchases to NMVTIS through services like Add123.com or Nexus' integrated reporting system. Failure to report vehicles results in a $1,500 fine PER VEHICLE by the federal government. Nexus handles vehicle purchases, VIN number decoding and NMVTIS reporting automatically!

State Requirements

In order to sell scrap metal, sellers will be required to:

Allow a copy of the driver's license or state ID card belonging to the person delivering the goods; ***
Sign a statement indicating that they are the owner of or are authorized to sell the metal;
Sign a statement that they have not been convicted of metal theft (which includes the following statement: "I am the rightful owner of the material described above, or am entitled by the rightful owner to sell the material described above.") This statement must be signed by seller, include date and time of transaction and include a witness signature by the buyer.
Sign an affidavit stating: “He or she understands that: A secondary metals recycler is any person who is engaged, from a fixed location or otherwise, in the business in this state of paying compensation for regulated metal property that has served its original economic purpose, whether or not engaged in the business of performing the manufacturing process by which regulated metal property is converted into raw material products consisting of prepared grades and having an existing or potential economic value. No ferrous metals, nonferrous metals, aluminum property, copper property, or catalytic converters (batteries, aluminum beverage containers, used beverage containers, or similar beverage containers are exempt) may be purchased by a secondary metals recycler unless such secondary metals recycler is a holder of a valid permit issued pursuant to Article 14 of Chapter 1 of Title 10 of the Official Code of Georgia Annotated” ***

Buyer’s must:

Record make, model, state of issue and license plate number of sellers vehicle used to transport scrap (it is permissible to purchase scrap from a person not in a vehicle)
- Include type of vehicle: such as car, truck, van, etc.
Digital photo or video of the materials being sold.***
Keep a record of sellers name, address and date of sale
All sales tickets must have location of sale, date and time of the sale, as well as the initials of the clerk completing the sale.
- Must also show the weight, quantity and/or volume, and description of the material.
- Amount paid for the material.
- Sales tickets must be signed by the seller. Seller will receive a copy of the receipt and buyer will retain a copy.

· Buyer must maintain a copy of the check paid to the seller.

· Buyer must report purchased vehicle information to NMVTIS

· All vehicle sales must include obtaining the vehicle title.

· Tag and hold policies are in effect (up to 15 days)

NOTE: Know your local ordinances. Cities and counties can have different ordinances than the state.

All purchases must be paid by check or voucher made payable to seller. Purchaser is not allowed to cash checks written to seller.

Keep records, certifications, registrations, etc. on site for 2 years.

Scrap recyclers must maintain a record of all purchases for a minimum of two years and is subject to inspection by any law enforcement at any time. There is a 15-day tag-and-hold policy when notified by law enforcement to do so.

No copper coil can be purchased unless it is from a licensed contractor or a person with verifiable documentation that the coil came from a licensed contractor. A copy of the contractor’s license must be kept on file.

No copper wire that appears to have been burned or charred in an attempt to remove the surrounding insulation can be purchased from anyone except a licensed contractor (license must be kept on file), a person with a police report showing that the wire came from a fire at that persons property, or a secondary dealer with written proof from police or a licensed contractor that the material now belongs to them.

No burial objects can be purchased unless it is from a licensed funeral director a cemetery owner, a manufacturer or distributor of burial objects (must copy license for file), a person with verifiable documentation that they are doing business on the behalf of the above mentioned licensed individuals. Documentation must be kept on file.

When purchasing a motor vehicle as scrap, a recycler must obtain from the seller at the time of the purchase either of the following: (A) Vehicle title or (B) Executed MV-1SP (a cancellation of certificate of title for scrap vehicle form). TIME: Recyclers are required to submit the title or MV-1SP form within 72 hours of receipt to the Motor Vehicle Division of the Department of Revenue. The form lists current directions and the address to mail the form. Falsification of the MV-1SP form is a felony.

***A list of scrap vehicle parts must be made available to the department 48 hours after the close of business day the items were purchased.

It is unlawful for metal recyclers to purchase or sell regulated metal between the hours of 7 p.m. and 7 a.m.

All secondary metal recyclers must be registered with the Sheriff of each county that they do business with. They must also be registered with the Secretary of State every 12 months.

Tires - The Georgia law requires retail dealers to collect a $1 fee and to keep accurate records for every replacement tire sold. Anyone who generates scrap tires must have a Scrap Tire Generator Identification Number issued by the state Environmental Protection Division (EPD). Additionally, anyone transporting scrap tires must have a carrier permit issued by the state Director of the EPD.
